Draft Local Law 3 - 09/27/2024

SECTION 1 PURPOSE

The Town recognizes that it would be beneficial for the Town to control and regulate the transient or short-term (less than thirty [30] days) renting or leasing of residential properties within the Town of Preble, as well as to eventually prohibit said use in the R1L zoning districts of the town

The provisions of this Local Law are intended to preserve and protect the health, character, safety and general welfare of the residential neighborhoods and rural areas where short-term rental properties can and can not be operated, and to reduce the risk for potential adverse effects that can occur with the operation of short-term rental properties.....

The objectives of this Zoning Ordinance are:

1). Protect the Cortland Valley Sole Source Aquifer.

Residency Requirements

A local law to establish the residency requirements for the appointed offices of Code Enforcement Officer, Town Attorney, and Dog Control Officer.

Keyhole Development

Whether it's called keyhole, funnel, portal or corridor-development, the concept is the same. When the purchase of real estate that is 'not' located on a lake or river, provides ongoing deeded use of a separate parcel that 'is' on the waterfront, people can be funneled through the waterfront parcel (or keyhole), using it as a corridor.

Such a real estate extends all normal privileges of ownership to the keyhole, including but not limited to use by those leasing the primary residence, visitors enjoying a short-term vacation rental* and owner-tenants. All have authority to utilize the waterfront lot. Keyhole rights follows the residential home deed; transferring authority to use the remote lot in perpetuity.

Local Law 1 of 2024

A local law enacting a moratorium ot temporarily suspend hte use of dwelings as transient or short-term rentals.

Outdoor Wood Boilers Law

This Local Law is enacted to ensure that outdoor wood boilers are utilized in a manner that does not create a nuisance and in recognition of the impact that outdoor wood boilers have on the health, safety, and welfare of the citizens of the Town of Preble.

Dog Licensing

The purpose of this local law is to provide for the licensing and identification of dogs, the control and protection of the dog population and the protection of persons, property, domestic animals and other animals from dog attack and damage.
